Publishers participating in the QualAds web site are required to adhere to the following policies. We ask that you read these policies carefully and refer to this document often. If you fail to comply with these policies, we may disable ad serving to your site and/or disable (cancel) your QualAds account. While in many cases we prefer to work with publishers to achieve policy compliance, we reserve the right to disable any account at any time. If your account is disabled, you will not be eligible for further participation in the QualAds web site.

QualAds reserves the right to modify or revise these Terms of Service and/or Privacy Statement or its other policies at any time at its sole discretion. You are bound by such modification or revision, and should therefore visit this page frequently to review the terms. Your continued use of the site or Service following the posting of any changes or modifications to these Terms of Service and/or Privacy Statement will constitute your acceptance of such changes or modifications. In the event that you do not agree to any changes or modifications of these Terms of Service and/or Privacy Statement, you must not continue to use the site

Publisher WebSite Content

While QualAds offers broad access to a variety of publisher content, publishers in the QualAds network may only place QualAds regions on sites that adhere to our content guidelines.

Sites displaying QualAds may not include:

  • Violent content, racial intolerance, or advocacy against any individual, group, or organization

  • Pornography, adult, or mature content

  • Sales or promotion or distribution of prescription drugs, illicit drugs and drug paraphernalia or illegal items

  • Any other content that is illegal, promotes illegal activity, or infringes on the legal rights of others

Copyrighted Material

Website publishers may not display QualAds on web pages with content protected by copyright law unless they have the necessary legal rights to display that content.

Site and Ad Behavior

Sites showing QualAds should be easy for users to navigate and should not contain excessive pop-ups. QualAds code may not be altered, nor may standard ad behavior be manipulated in any way that is not explicitly permitted by QualAds

  • Sites showing QualAds may not contain pop-ups or pop-unders that interfere with site navigation, change user preferences, or initiate downloads.

  • Any QualAds code must be used as-is without modification. QualAds participants are not allowed to alter any portion of the code or change the behavior, targeting, or delivery of ads.

  • No QualAds code may be integrated into a software application.

  • Webpages containing QualAds code may not be loaded by any software that can trigger pop-ups, redirect users to unwanted websites, modify browser settings, or otherwise interfere with site navigation. It is your responsibility to ensure that no ad network or affiliate uses such methods to direct traffic to pages that contain your QualAds code.

  • Regions cannot be removed from sites while paid advertisements are booked in them.

  • Publishers are not permitted to add sites that they are not affiliated with. Publishers who do so will be permanently banned from our network.

  • The User will not use the service to send chain letters, junk mail, spamming, or distribution lists to any User, Account Manager or other at any time.

  • The User agrees not to transmit any unlawful, harassing, abusive, threatening, harmful, objectionable material of any kind or nature.

  • The User further agrees not to transmit any materials that violates any applicable local, state, national, or international law or regulation.

Ad Placement

QualAds offers a number of ad formats and advertising products. Publishers are encouraged to experiment with a variety of placements, provided the following policies are respected:

  • Elements on a page must not obscure any portion of the ads

  • QualAds must appear on a visible portion of at least one page on your website

  • QualAds may not be placed exclusively on pages published specifically for the purpose of showing ads.

Copyrighted Material

Advertisements in the QualAds network must adhere to copyright law and should not use images unless they have the necessary legal rights to display that content.

Advertisement Landing Pages

Advertisements in the QualAds network should not link to pages that create a negative browsing experience for the user. In particular, advertisement landing pages may not be loaded by any software that can trigger pop-ups, redirect users to unwanted websites, modify browser settings, or otherwise interfere with site navigation. Advertisements will not use the service to send chain letters, junk mail, spamming, or distribution lists to any User, Account Manager or other at any time. Advertisements agree not to transmit any unlawful, harassing, abusive, threatening, harmful, objectionable material of any kind or nature. Advertisements further agree not to transmit any materials that violates any applicable local, state, national, or international law or regulation.

Payments, Account Credit and Pricing

Earnings include approved site Ad earnings and Affiliate earnings. Payments include Earnings, fees and charges.

A standard Ad commission of 70% of the cost of the Ad Booking will be paid for Sponsored Ads and on a per click basis for Run of Network Ads(RON) to the Publisher.

Run of Network Ad earnings are made in the month clicks were made. Sponsored Ad earnings are made in the month Ad Bookings complete.

Affiliate earnings are made in the month the Ad Bookings complete.

Earnings may be modified at any time and for any reason by the Account Manager.

When a site is approved, any previously accumulated Earnings will be carried over to the next Payment.

Payments will be made every friday of he week.

Payments will be made into the nominated account via Paypal or Moneybookers. Minimum Earnings apply ($10) and will be carried over to the next cycle in the event these minimums are not met.

Failed Payments due to the incorrect provision of information by the Publisher will delay the payment process. A re-payment will only be made once the initial funds are recovered and all extra charges will be paid for by the Publisher.

Earnings will be carried over to the next cycle if the Publisher has not provided sufficient Payment Details.

Payments will not be made if the User is banned from the Service.

Funds can be deposited into Account Credit via Paypal or Moneybookers. Payments are usually instant but may be delayed.

QualAds.com reserves the right to ban a User account in the event a payment is reversed for any reason to protect the Service and its Users.

Account Credit will not be refunded in the event the User changes their mind or is banned from the Service.

Account Credit is not redeemable for cash nor is transferable.

All prices are quoted in $USD and exclude local taxes, which are the responsibility of the User.

Disclaimer

The QualAds network, services and the results generated therefrom are provided on an "as is" and "as available" basis, without any warranty of any kind and without any guarantee of continuous or uninterrupted display or distribution of any ad. In the event of interruption of display or distribution of any ad, QualAds sole obligation will be to restore service as soon as practicable. Except as stated herein, QualAds disclaims all warranties of any kind, whether express or implied including, but not limited to, the implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Given the nature of telecommunication systems, particularly the internet, QualAds.com does not guarantee that the Service or the site will be free of interruptions, errors or virus free. Other than for gross negligence and willful misconduct, in no event will QualAds.com be liable for any consequential, indirect, incidental, punitive, special or exemplary damages whatsoever including, without limitation, damages for loss of profits, business interruption, loss of information and the like, incurred by the other party arising out of the Service, even if it has been advised of the possibility of such damages. QualAds.com is likewise not liable for any loss suffered or incurred by the User to the extent that it is caused by the User or any other User. QualAds is not a Publisher or an Advertiser. QualAds merely acts as an online avenue to allow Users to communicate and offer, sell and buy online advertising, at anytime, from anywhere, in a variety of formats. QualAds.com does not endorse or guarantee the quality of Advertiser goods and services, Publisher sites or Ad Media.

If you are dissatisfied with any of the contents of the site, or do not agree with these terms of service, with QualAds.com's privacy policy or any other policies of the site, your sole remedy is to discontinue your use of the site.
